Your Right To Chose

Consumer Rights

Your Right To Choose Your Own Casket

Families have the legal right to purchase a casket from the provider of their choice and have it used by the funeral home handling the service.

Protected By Federal Law

Families Have More Choices Than They Realize

Many families believe they must buy a casket directly from the funeral home. Federal consumer protection rules give families the freedom to compare options, choose only the goods and services they want, and provide the funeral home with a casket purchased elsewhere.

Choose Your Supplier

You may purchase a casket from a third-party provider such as Jordan River Caskets.

Use It With A Funeral Home

Funeral providers cannot refuse to handle a casket bought online, from a casket store, or another outside source.

No Extra Handling Fee

Funeral homes cannot charge an extra fee simply because the casket was purchased from another provider.

The FTC Funeral Rule

What The Funeral Rule Allows Families To Do

The Federal Trade Commission Funeral Rule helps consumers make informed funeral decisions. It allows families to compare prices, select only the arrangements they want, and purchase funeral goods separately instead of being forced into a package.

Buy only what you want.
You do not have to accept a package that includes items you do not want.
Receive price information.
Funeral homes must provide price information and written itemized statements.
Provide your own casket or urn.
A funeral provider cannot refuse it or charge a fee just because it was bought elsewhere.
Compare before deciding.
Families have the right to review options before purchasing.
California Consumer Protection

California Also Supports Price Transparency

California’s Cemetery and Funeral Bureau provides consumer guidance for funeral and cemetery purchases. It explains that funeral establishments must quote prices over the telephone, provide price lists when required, and give an itemized statement showing selected goods and services.

California guidance also states that funeral establishments may not charge a handling fee if a family wishes to use a family-built casket or purchase one elsewhere, although the casket must meet applicable cemetery standards.
